The Classification Rules and Classification Catalogue of Cosmetics are open for comment | Beauty and health law
On July 29, in order to implement the "Regulations on the Supervision and Administration of Cosmetics", the State Drug Administration drafted the "Classification Rules and Classification Catalogue of Cosmetics" (draft for comments), and formally solicited comments from the public. The draft for comments is as follows:
Cosmetic classification rules and categories

Article 1 In order to regulate the production and operation of cosmetics and ensure the quality and safety of cosmetics, these rules and catalogues are formulated in accordance with the Regulations on the Supervision and Administration of Cosmetics and the provisions of relevant laws and regulations.
Article 2 (Scope of Application) These rules and catalogs are applicable to the statistics, supervision and administration of cosmetic products, and are used to determine the attribution of products.
The third article (classification basis) adopts the line classification method, according to the efficacy claim, the role of the product dosage form, the user group, while considering the use method, the cosmetics are classified.
The fourth (coding structure) adopts hierarchical code, and the code is divided into five levels, which are in turn the efficacy claim, the role, the product dosage form, the user group and the use method. The classification and coding directories of each level are shown in Table 1-5.
Article 5 (Classification Rules) The codes from the first layer to the fifth layer are combined in sequence, and the layers are distinguished by "-". Each layer is coded with 2 digits or letters.
When multiple efficacy claims, action sites, product dosage forms or user groups are involved, they can be arranged according to the established coding order from smallest to largest.
Article 6 (Efficacy claims) Efficacy claims shall be coded for direct cosmetic efficacy claims, and the encoded efficacy claims shall have the corresponding scientific basis.
Article 7 (Site of action) The site of action should be reasonably selected according to the specific product application site in the product label.
Article 8 (Product dosage form) Product dosage forms are divided mainly according to the production process and finished product status, and are consistent with the production license projects.
Article 9 (Method of Use) The method of using the product shall be coded according to the relevant definition requirements of the Technical Code for Cosmetic Safety.
Article 10 (Sets and products) Products for which two or more doses must be used together and products for which two or more doses cannot be split shall be classified and coded according to one product.
Article 11 (New efficacy) Where letters appear in the efficacy claim, action site, product dosage form or user group code, the product shall be managed as a special cosmetic.
Article 12 (Time of Implementation) These Measures shall come into force on day (day) of month (day) of month (day) of year (year).
